3. What does this Policy cover?

This Privacy Policy applies only to your use of Our Site. Our Site may contain links to other websites. Embedded content from other websites

5. What data do we collect?

Depending upon your use of Our Site, you may give us information about you by filling in forms, registering to use our site, subscribing to our service, downloading information, participating in social media functions, taking part in a survey or reporting a problem with our site. Leaving comments and reviews on the website

5.10 When you leave comments or reviews on Our Site we collect the data shown in the comments form, and also the visitor’s IP address and browser user agent string to help spam detection. An anonymised string created from your email address (also called a hash) may be provided to the Gravatar service to see if you are using it. The Gravatar service Privacy Policy is available here: https://automattic.com/privacy/. After approval of your comment, your profile picture is visible to the public in the context of your comment.

5.11 If you leave a comment on our site you may opt in to saving your name, email address and website in cookies. These are for your convenience so that you do not have to fill in your details again when you leave another comment. These cookies will last for one year.

5.12 If you visit our login page, we will set a temporary cookie to determine if your browser accepts cookies. This cookie contains no personal data and is discarded when you close your browser.

5.13 When you log in, we will also set up several cookies to save your login information and your screen display choices. Login cookies last for two days, and screen options cookies last for a year. If you select "Remember Me", your login will persist for two weeks. If you log out of your account, the login cookies will be removed.

Your shopping experience

While you visit our site, we’ll track:

5.14 Products you’ve viewed: we’ll use this to, for example, show you products you’ve recently viewed;

5.15 Location, IP address and browser type: we’ll use this for purposes like estimating taxes and shipping;

5.16 Shipping address: we’ll ask you to enter this so we can, for instance, estimate shipping before you place an order, and send you the order.

5.17 We’ll also use cookies to keep track of basket contents while you’re browsing our site.

5.18 When you purchase from us, we’ll ask you to provide information including your name, billing address, shipping address, email address, phone number, credit card/payment details and optional account information like username and password. We’ll use this information for purposes, such as, to:

5.18.1 Send you information about your account and order;
5.18.2 Respond to your requests, including refunds and complaints;
5.18.3 Process payments and prevent fraud;
5.18.4 Set up your account for our store;
5.18.5 Comply with any legal obligations we have, such as calculating taxes;
5.18.6 Improve our store offerings;

5.19 If you create an account, we will store your name, address, email and phone number, which will be used to populate the checkout for future orders, and your order history will be visible here too.

Anti-Spam

5.20 We collect information about visitors who comment on sites that use our Akismet Anti-spam service. The information we collect includes the commenter's IP address, user agent, referrer, and site URL (along with other information directly provided by the commenter such as their name, username, email address, and the comment itself).

6. How do we use your data?

6.1 All Personal Data is processed and stored securely, for no longer than is necessary in light of the reason(s) for which it was first collected. We will comply with Our obligations and safeguard your rights under the UK GDPR at all times. For more details on security see section 7, below.
6.2 Our use of your Personal Data will always have a lawful basis, either because it is necessary for Our performance of a contract with you, because you have consented to Our use of your Personal Data (e.g. by subscribing to emails), or because it is in Our legitimate interests. 6.2.1 Providing and managing your access to Our Site;
6.2.2 Supplying Our services to you such as fulfilling orders and free sample requests (please note that We require your Personal Data in order to respond to requests for our services and online resources);

6.4 You have the right to withdraw your consent to Us using your Personal Data at any time, and to request that We delete it.
6.5 We retain your personal information as long as it is necessary to provide the service requested by our customers, or for as long as consent is granted, unless otherwise prohibited by law. In addition, if such information is relevant, we retain it for the period required by applicable UK tax law (currently 6 years).

7. How and Where Do We Store Your Data?

7.1 We only keep your Personal Data for as long as We need to in order to use it as described above in section 6, and/or for as long as We have your permission to keep it.
7.1.1 Personal Data stored on Our Site will be retained for no longer than two years after your interaction with Us.
7.1.2 Google Analytics data is stored for no longer than two years.

7.2 Some or all of your data may be stored outside of the European Economic Area (“the EEA”) (The EEA consists of all EU member states, plus Norway, Iceland, and Liechtenstein). You are deemed to accept and agree to this by using Our Site and submitting information to Us. If We do store data outside the EEA, We will take all reasonable steps to ensure that your data is treated as safely and securely as it would be within the UK and under GDPR as it forms parts of the United Kingdom domestic law by virtue of Section 3 of the European Union (Withdrawal) Act 2018 (“UK GDPR”) including:
7.2.1 Ensuring that our partners are UK GDPR compliant;
7.3 Data security is very important to Us, and to protect your data We have taken suitable measures to safeguard and secure data collected through Our Site.
7.4 Steps We take to secure and protect your data include:
7.4.1 Data stored on our website is protected by layers of security software and firewalls;
7.4.2 Back ups of our website are stored securely in a UK GDPR compliant way;
7.4.3 SSL/TLS encryption of all data transmitted via our website;
7.4.4 Two-factor is enabled for Our team to access customer data from Our Site and third party data processors.

Third Party Data Processors

7.5 Our carefully selected partners and service providers may process personal information about you on our behalf as described below:

7.5.1 Royal Mail is our shipping partner and captures Personal Data in order to create shipping labels and postage;
7.5.2 Google Workspace hosts our emails;
7.5.3 Unlimited Web Hosting hosts our website and database, and our website is administered by Chocolate Box Studios Limited;
7.5.4 Fernleaf Systems Limited hosts our website and database backups;
7.5.5 Stripe captures Customer orders and processes credit and debit card payments securely, including the options of using Google Pay, Apple Pay and Link transactions. Stripe's privacy policy can be found here;
7.5.6 PayPal captures Customer orders and processes customer payments securely. Paypal's privacy policy can be found here.
7.5.7 Akismet Anti-Spam service. See section 5.20.

Email Service Providers: Mailing Lists

7.6 When visitors sign up to our newsletter mailing list, they agree to receive occasional emails from us about our services. If you sign up to our newsletter mailing list, we will collect your name and email address, and your data will be processed on behalf of Us by SendGrid in order for us to send emails to you and monitor email performance. 7.7 When visitors request a free product sample, or make a purchase from our website store, we will capture their name, email address and a record of the customer interaction, and this data will be processed on behalf of Us by Mailchimp in order to send courtesy emails following up the customer interaction and to monitor email performance. Website analytics

7.8 We collect anonymised website statistics using Google Analytics to measure the traffic and usage of Our Site.
7.9 We also collect anonymised usage analytics of pop-ups on Our Site.

8. Do we share your data?

8.1 Subject to section 8.2, We will not selll or share any of your data with any third parties for any purposes, except for those listed in section 7 above.
8.2 In certain circumstances, We may be legally required to share certain data held by Us, which may include your Personal Data, for example, where We are involved in legal proceedings, where We are complying with legal obligations, a court order, or a governmental authority.
Note: If you request a password reset, your IP address will be included in the reset email. All emails sent via the website are encrypted via SSL/TLS.

9. What happens if our organisation changes hands?

9.1 We may, from time to time, expand or reduce Our organisation and this may involve the sale and/or the transfer of control of all or part of Our organisation. Any Personal Data that you have provided will, where it is relevant to any part of Our organisation that is being transferred, be transferred along with that part and the new owner or newly controlling party will, under the terms of this Privacy Policy, be permitted to use that data only for the same purposes for which it was originally collected by Us.
9.2 In the event that any of your data is to be transferred in such a manner, you will not be contacted in advance and informed of the changes.

13.1 Our Site places and accesses certain first party Cookies on your computer or device. First party Cookies are those placed directly by Us and are used only by Us. In addition, Our Site uses analytics services provided by Google Analytics, and content provided by Facebook, which also use Cookies.
